Telegram. The Governor of Hong Kong to the Secretary of State

for the Colonies.

Your telegram 11th September, your telegram 23rd September the one mode of control and supervision provided by trading with Enemy Act would be impracticable here owing to impossibility of finding a le controllers. If no objection I propose to take power under Trading with Enemy Ordinance to be passed October 1st to continue already existing restriction of local branches enemy firme. Restrictions as follows (1) trade onl local name and not in name of whole firm (2) regular payme British Banke of all sums of money. Is Article 5 Proclamation

September 9th to be regarded as in effect abrogating rules regard-

ing dissolution of partnership in consequence of declaration of war main point (is (1) Bank will give credit to whole firm but not to local partners (2) if trade in name of whole firm should

be allowed partner enemy territory may have during the war benefits to be derived from trade of (with) branch (3) existence of certain

neutral banks in the Colony and in Chinese territory and existence of branches enemy firms in Chinese territory and possibility of sending telegrams writing to such branches from Canton makes it difficult here to prevent remittance to German Empire (4) diffi- culty of applying to present conditions of Hong Kong doctrine of double comercial domicile policy followed here throughout has been to prevent sums of money or its equivalent reaching German dominions and not to stifle fair competition.
